1. Purpose

The present Terms & Conditions (hereinafter, “Terms”) regulate the agreement between the company SITUAS CONSULTANCY (hereinafter, “SITUAS”) and the customer (“Customer”) formalised through the website www.situas.com (the “Website”) for purchasing Buyer’s Report from SITUAS via the Website.

By using this website, the reader will be deemed to have accepted these terms and conditions. It is recommended that the Customer prints and/or saves a copy of the Terms when placing the order.

2. Contracting Procedure

The service depends in large part on the property size and use and the geographic location. We recomand you to contact SITUAS via e-mail for a initial meeting free of charge in our office or via video-conference for further information.

3. Price and Payment

The prices and offers presented on the Website include Value-Added Tax (“VAT”) and are valid only for orders placed on-line through the Website. Prices are given in Euros. To pay for the order the Customer may use Bank transfer or PayPal. The charge will be made upon confirmation of the order. The prices shown on the Website are subject to change. SITUAS reserves the right to change prices without prior notice. However, once the confirmation of receipt of an order is received from SITUAS, the price payable in respect of that order will not be changed. SITUAS informs that despite careful updates of the Website the prices shown may be erroneous. Any prices shown in error will be amended as soon as possible and shall not be binding on SITUAS.

4. Transport and Delivery

The Delivery of the report will be made by sending an PDF file to your e-mail account. Orders are usually delivered within 3 to 5 business days. The delivery schedule is usually met, and although SITUAS cannot guarantee punctuality.

5. Delivery Expenses

Due to that the report is sent as a PDF file there doesn`t existe any dilivery expenses.

6. Refunds

SITUAS respects the consumer protection law, although, SITUAS reserves the right to reject any order as well as cancel or not accept a confirmed order. No exchange, compensation or refund is available for purchases made, due to their individual condition for a specific property on a specific date.

7. Liability

These Terms set out the full extent of SITUAS´ obligations and liabilities in respect of the supply of the products. There are no warranties, conditions or other terms that are binding on SITUAS except as expressly stated in the Terms. SITUAS also assumes no legal liability or responsibility for the accuracy, completeness, or usefulness of any information on this website.

8. Protection of Personal Data

In accordance with Spanish Organic Law No. 15/1999 dated 13th December 1999, concerning the Protection of Data of a Personal Nature, Users are informed that their personal data will be included in files owned by SITUAS for the purposes of customer relation management. Users may exercise their right to access, rectify, delete and object in writing an email to SITUAS, attached by a copy of the ID: lopd@situas.com

The User guarantees the truthfulness and accuracy of the personal data provided to SITUAS.

9. Right to change Terms

SITUAS may change the Terms at any time, without prior notice to the Customer. Also, once the Customer has received confirmation of receipt from SITUAS of the order, the Terms applicable to that order will not be changed. SITUAS reserves the right, at any time in our sole discretion, to: modify, suspend or discontinue the Website or any service, content, feature or product offered through the webite, with or without notice.

10. Applicable Legislation

Purchases made through the SITUAS Website and under the present Terms are subject to Spanish law.

11. Competent Jurisdiction

Any dispute or discrepancy arising from the application or interpretation of these Terms, as well as the contracts incorporating them, shall be resolved in the courts of the City of Valencia, Spain, which will have exclusive competence over any other jurisdiction.
